Requirements for grant of approval for a cosmetic advertisement content

In recent times, the Government has intensified its efforts to inspect, monitor, and strictly sanction enterprises engaged in trading counterfeit goods, substandard products, or goods of unclear origin. This inspection campaign has also expanded to the field of advertising, particularly regarding false or misleading advertisements for cosmetic products – an area in which numerous businesses have already been inspected and penalized.  

A notable example is the case involving Mailisa Company. According to reports from the press, several cosmetic products under the brand names ‘DOCTOR MAGIC’, ‘MAIKA BEAUTY’, and ‘MK’, manufactured or imported by MK Skincare Import–Export Trading and Manufacturing Co., Ltd. (Address: K31, Thoi An Residential Area, Le Thi Rieng Street, Thoi An Ward, Ho Chi Minh City; Enterprise No. 0314633814) – the organization responsible for placing these cosmetic products on the market – were found to exhibit signs of false advertising, containing misleading claims that may pose risks to consumer health. The competent authorities are currently conducting product testing to verify the alleged violations. 

This case illustrates the practical consequences that may arise, including business disruption and significant damage to corporate reputation. Therefore, this article focuses on requirements for grant of approval for a cosmetic advertisement content. 

1. General Provision:

Pursuant to Article 6 of Circular No. 09/2015/TT-BYT, the conditions for obtaining confirmation of cosmetic advertising content include:  

  • Cosmetic products must conform to advertisement requirements stipulated in Point b Clause 4 Article 20 of the Law on Advertising. 
  • Cosmetic advertisement contents must conform to regulations laid down in Article 4 of the Decree No. 181/2013/NĐ-CP and the followings: 
  1. Do not use images, costumes, names, mails and articles of other organizations, healthcare establishments, doctors, pharmacists or medical staff; 
  2. Features and effects of a cosmetic product must accord with its nature, classification as well as those that have been already made known to the public in accordance with legal regulations. 
  • All necessary documents must be submitted as stipulated in Article 15 of Circular 09/2015/TT-BYT. 
  • The applicant for approval for advertisement contents is the organization that signs its name on the product notification, or the representative office of that organization, or the organization with its legal standing authorized in writing by that organization.

2. Cosmetic products must conform to advertisement requirements of the Law on Advertising: 

Pursuant to point b, Clause 4, Article 20 of Law on Advertisings 2012, having the cosmetics announcement sheet as prescribed by law provisions on medicines when advertising cosmetics. This means that the cosmetic product being advertised must be one that is already eligible for circulation on the market in accordance with legal regulations.  

3. Cosmetic advertisement contents must conform to regulations: 

Cosmetic advertisement contents must conform to regulations laid down in Article 4 of the Decree No. 181/2013/NĐ-CP means that: 

  • The contents of cosmetics advertisements must be conformable with:
  1. The announcement of cosmetics prescribed in pharmacy laws;
  2. Documents proving the safety and effects of the cosmetics, instructions on announcement of cosmetics effects given by an international association (if any). 
  • A cosmetics advertisement must contain: 
  1. Names of the cosmetics;
  2. Effects and uses of the cosmetics; 
  3. Name and address of the entity in charge of launching the product; 
  4. The warnings prescribed in international agreements.
  • Do not advertise cosmetics in a way that cause people to confuse them with medicines. 
  • The information: names of the cosmetics, effects and uses of the cosmetics, and the warnings prescribed in international agreements must be clearly spoken when advertising cosmetics on audio and video news.  

This means that the advertising content must be consistent with the information already registered with the state health authorities. The names of the cosmetics, effects and uses of the cosmetics, name and address of the entity in charge of launching the product, and the warnings prescribed in international agreements must all be fully listed. As for cosmetic ingredients, this is not a mandatory item under the above requirements; therefore, enterprises may decide whether to include it. However, if listed, the information must strictly correspond to that declared in the cosmetic product notification dossier.  

Furthermore, the advertisement must not use images, costumes, names, mails and articles of other organizations, healthcare establishments, doctors, pharmacists or medical staffFeatures and effects of a cosmetic product must accord with its nature, classification as well as those that have been already made known to the public in accordance with legal regulations. 

4. All necessary documents must be submitted as stipulated by law: 

Enterprises carrying out procedures for grant of approval for a cosmetic advertisement content must prepare the documents required under Articles 13 and 15 of Circular No. 09/2015/TT-BYT. It should be noted that each means of advertising is subject to different requirements and dossier components, and enterprises must prepare the appropriate documents corresponding to the means of advertisement they intend to use. Regarding the application dossier, the law sets out specific requirements on its components, presentation format, and mandatory information, all of which must be strictly complied with.  

In addition, if the advertisement content provides information about features or useful effects of these products but such information are not included in the notification of cosmetic products of which the receiving numbers have been issued by competent authorities, the enterprise must provide the valid and authoritative materials that demonstrate features and useful effects of these cosmetic products. 

5. The applicant for approval for advertisement contents:

The law permits the following entities to apply for confirmation of cosmetic advertising content: 

  • The organization that signs its name on the product notification, or  
  • The representative office of that organization, or  
  • The organization with its legal standing authorized in writing by that organization. 

However, it is important to distinguish clearly between the entity applying for approval for a cosmetic advertisement content and the entity in charge of launching the product — one of the mandatory details that must be included in cosmetic advertisements under the law. Accordingly, while the applicants for cosmetic advertising content confirmation may be any of the three entities listed above, the entity in charge of launching the product must be the one recorded in the announcement of cosmetics, and this information must be clearly reflected in the advertisement, advertising materials, and related marketing content.  

The above discussion reflects the conditions for grant of approval for a cosmetic advertisement content as recorded at the time of publication of this article. At the time an enterprise conducts the procedures, legal provisions may have changed, and state authorities may adopt different interpretations or positions. Therefore, enterprises should proactively re-examine the applicable legal regulations and the views of the competent authorities before proceeding.
