Procedure for issuance of a certificate of registration of product and management system certification activities: Eligibility conditions, application dossier and implementation process
Legal basis
- Law on Standards and Technical Regulations 2006, as amended and supplemented in 2018 and 2025;
- Government Decree No. 22/2026/ND-CP dated 16 January 2026 detailing the Law on Standards and Technical Regulations;
Introduction
Product and management system certification is a form of conformity assessment that helps ensure that products, services, processes and management systems comply with applicable standards or technical regulations. Amid increasingly stringent product quality requirements and international integration, a certification body’s full compliance with the applicable operating conditions is not only a legal requirement but also an important factor in building credibility and trust with clients and business partners.
To strengthen state management in this field, Decree No. 22/2026/ND-CP sets out specific conditions, application dossier requirements and procedures for the issuance of Certificates of Registration of Product and Management System Certification Activities to conformity assessment bodies. A clear understanding of these regulations enables organizations to proactively prepare their application dossiers, satisfy the applicable competence requirements and shorten the time required to complete the administrative procedure.
In this article, Apolat Legal summarizes the key regulations on eligibility conditions, application dossiers, competent authorities, implementation procedures and certain practical considerations relating to the issuance of a Certificate of Registration of Product and Management System Certification Activities under the prevailing law.
1. When is the procedure for issuance of a Certificate of Registration of Product and Management System Certification Activities required?
Product certification and management system certification play an important role in assessing the conformity of products, processes and management systems with applicable standards or technical regulations. To ensure the objectivity, transparency and professional competence of certification bodies, the law requires an organization to obtain a Certificate of Registration of Product and Management System Certification Activities from the competent state authority before carrying out such activities.
Accordingly, organizations wishing to provide product certification or management system certification services within the scope of the Law on Standards and Technical Regulations must complete the registration procedure before commencing operations.
2. Conditions for providing product and management system certification services
Pursuant to Article 50 of Decree No. 22/2026/ND-CP, an organization applying to register product and management system certification activities must satisfy the following conditions:
- Organizational form: It must be one of the organizational forms specified in Article 50 of the Law on Standards and Technical Regulations (a non-business unit; a science and technology organization; an economic organization or socio-professional organization; or a foreign conformity assessment body established and operating in Vietnam).
- Management system and operational competence:
- For product and goods certification activities: compliance with TCVN ISO/IEC 17065, ISO/IEC 17065, standards applicable to specialized product certification, relevant guidelines of the International Accreditation Forum (IAF), or standards corresponding to the requirements of a specific certification scheme;
- For management system certification activities: compliance with TCVN ISO/IEC 17021-1, ISO/IEC 17021-1, relevant IAF guidelines, or standards corresponding to the requirements of a specific certification scheme.
- Personnel: The organization must have at least six (06) official assessors who are public employees or employees working under definite-term labor contracts of at least 12 months or indefinite-term labor contracts. Each assessor must:
- Hold at least a bachelor’s degree;
- Have completed training in the relevant certification assessment skills, unless exempted in accordance with law;
- Hold a certificate of completion of training in specialized product certification techniques, where required by sector-specific legislation;
- Have at least 20 person-days of assessment experience in the relevant certification scheme.
For a new management system certification scheme, an assessor must have at least 20 person-days of assessment experience in another management system certification scheme of the same nature or logic, or within the same field, or at least five (05) person-days of assessment experience in the certification scheme being registered.
For a new product certification scheme or a product added to the registered scope of certification activities, an assessor must have at least five (05) person-days of assessment experience with products of the same type, technology or testing method.
Where an additional certification field is registered, the organization must have at least two (02) official assessors for each additional field. Such assessors must be public employees or employees working under definite-term labor contracts for professional work of at least 12 months or indefinite-term labor contracts, and must satisfy the conditions set out in this Clause.
3. Application dossier for issuance of the Certificate
Pursuant to Clause 2, Article 51 of Decree No. 22/2026/ND-CP, the organization must prepare one (01) application dossier for issuance of a Certificate of Registration of Product and Management System Certification Activities, comprising:
- An application form for registration of certification activities made according to Form No. 01 in the Appendix issued together with Decree No. 22/2026/ND-CP.
- Documents for each assessor, including copies of the recruitment decision or labor contract; copies of the relevant degrees and certificates; a summary of assessment experience using Form No. 03; and documents evidencing the assessor’s practical assessment experience.
- Documents evidencing the competence to conduct certification activities, to be prepared depending on the organization’s accreditation status:
- If accredited for the entire registered scope: a copy of the Accreditation Certificate, together with the accredited scope;
- If the registered scope exceeds the accredited scope: the Accreditation Certificate, the accredited scope and a declaration of competence using Form No. 17 for the unaccredited scope;
- If not accredited: a declaration of competence using Form No. 17, demonstrating compliance with TCVN ISO/IEC 17065 or ISO/IEC 17065 for product certification, or TCVN ISO/IEC 17021-1 or ISO/IEC 17021-1 for management system certification.
- A specimen Certificate and certification mark intended for use in certification activities.
4. Competent authority
Pursuant to Clause 1, Article 51 of Decree No. 22/2026/ND-CP, the application dossier must be submitted to the specialized agency assigned by the Chairperson of the provincial-level People’s Committee to receive and appraise applications from organizations headquartered within the province. Upon completion of the appraisal, the Chairperson of the provincial-level People’s Committee shall consider issuing the Certificate of Registration of Product and Management System Certification Activities in accordance with law.
The organization may submit the dossier in person, by post or through the online public service system if the procedure is available electronically.
5. Implementation procedure
Pursuant to Clause 1, Article 53 of Decree No. 22/2026/ND-CP, the procedure for initial issuance of a Certificate of Registration of Product and Management System Certification Activities is as follows:
- Step 1 – Submission of the application dossier: The certification body prepares and submits the dossier to the competent authority in accordance with law.
- Step 2 – Review of the dossier: If the dossier is incomplete, within three (03) working days from receipt, the receiving authority shall notify the certification body to amend and supplement the dossier.
- Step 3 – Issuance of the Certificate: If the dossier is complete and valid, within seven (07) working days from receipt, the receiving authority shall issue the Certificate of Registration of Product and Management System Certification Activities using Form No. 10 in the Appendix issued together with Decree No. 22/2026/ND-CP.
The Certificate is valid for a maximum of five (05) years from the date of issuance. An electronic Certificate has the same legal validity as a paper Certificate.
Conclusion
The procedure for issuance of a Certificate of Registration of Product and Management System Certification Activities is mandatory for organizations wishing to provide certification services in cases where registration is required by law. Although the application dossier is not overly complex, demonstrating operational competence, an appropriate management system and consistency between the registered scope and the organization’s capabilities is critical to the competent authority’s consideration of the application.
Accordingly, an organization should prepare a complete and consistent dossier and carefully review all documents evidencing its competence before submission. This helps minimize requests for amendment or supplementation, shorten processing time and enable the organization to commence certification activities in compliance with law.
